These Terms and Conditions (“Terms”) govern your access to and use of the website www.balikbayanhandicrafts.com.ph and www.balikbayanlifestyle.com (the “Website”) and your purchase of products from Balikbayan Handicrafts Corporation (referred to as the “Company,” “we,” “us,” or “our”).
These Terms are written in accordance with the Consumer Act of the Philippines (Republic Act No. 7394), the Data Privacy Act of 2012 (RA 10173), and other applicable Philippine laws. Nothing in these Terms shall be construed as a waiver of consumer rights granted under law.
By accessing the Website or purchasing from us, you acknowledge that you have read, understood, and agreed to these Terms.

2. Consumer Rights
In compliance with the Consumer Act of the Philippines, consumers are entitled to:
- Accurate and sufficient information on products, prices, and charges
- Protection against deceptive, unfair, or unconscionable sales practices
- Fair treatment and good-faith resolution of complaints
- Statutory remedies for defective, damaged, or non-conforming goods
These Terms are intended to support—not limit—those rights.
3. Product Information and Pricing
- Product descriptions, prices, and availability are presented in good faith
- Prices on the Website may differ from those in physical stores due to promotions, inventory, and operating costs
- All applicable prices, taxes, and shipping charges are disclosed prior to checkout
- All prices are in Philippine Peso (PHP) unless otherwise stated
In the event of a pricing or typographical error, the consumer will be notified and given the option to proceed or cancel the order without penalty.
4. Ordering Process
To place an order, the consumer must:
- Select product(s) and quantity
- Provide complete and accurate billing and delivery information (including nearby landmarks, barangay name or number (#) if residing in the Philippines)
- Review the order summary, including shipping fees
- Confirm the order and agree to these Terms
Orders placed on weekends or holidays are processed on the next business day.
5. Payment Terms
- Payment must be settled within three (3) business days from order confirmation of the assigned Sales Representative.
- Accepted payment methods include:
- Direct bank deposit through BPI or BDO
- PayPal (for online transactions)
- Telegraphic fund transfer (remittance for international orders)
Cash on Delivery (COD) is not accepted.
Failure to complete payment within the prescribed period will result in automatic order cancellation without penalty to the consumer.
6. Order Confirmation
- Orders are confirmed within 24 hours
- Orders placed during weekends or holidays are confirmed on the next business day
- Processing and shipment commence only after payment verification
7. Shipping and Delivery
Deliveries are handled by accredited courier partners. Estimated delivery timelines (after payment confirmation) as follows:
- Metro Manila: 2 to 3 working days
- Outside Metro Manila: 3 to 7 working days
- International: 7 to 15 working days
Delivery timelines are estimates and may vary due to factors beyond the Company’s control such as courier delay, natural calamities, force majeure events, or other unforeseen disruptions.
8. Delivery Authorization
If the consumer is unavailable at the delivery address, the Company may require written authorization allowing a designated representative to receive the package.
9. Order Tracking
Tracking details are provided prior to shipment. Consumers may contact Sales or Customer Service for assistance with tracking concerns.
10. Order Changes and Cancellations
Requests for order changes or cancellations should be made immediately after placing an order. Approval depends on the processing status of the order.
Once fulfillment has begun, changes or cancellations may no longer be possible.
11. Damaged or Defective Items
In compliance with RA 7394:
- Items received with visible damage or defects should be reported within twenty-four (24) hours from receipt or within a reasonable period from discovery
- Clear photos and/or videos and order details must be submitted via email
- Valid claims will be evaluated fairly and in good faith
Nothing in this section limits statutory consumer remedies.
12. Refunds and Returns
As most products are handcrafted and carefully packaged:
- Refunds and returns are generally not accepted
- Exceptions may apply for damaged, defective, or non-conforming items, subject to evaluation and applicable consumer laws
This policy is implemented in accordance with the Consumer Act of the Philippines and does not waive consumer rights.
13. Reselling and Commercial Use
Products purchased through the Website are intended for personal use. Unauthorized reselling or commercial distribution is prohibited unless covered by a written reseller or wholesaler agreement with the Company.
14. Promotional Discounts and Gift Certificates
Promotional Discount Coupons or Vouchers, Membership Cards, and Gift Certificates are not valid for Website purchases unless explicitly stated on the instructions.
15. Intellectual Property
All Website content—including text, images, videos, graphics, logos, and designs—are the exclusive property of Balikbayan Handicrafts Corporation and are protected by Philippine Intellectual Property laws on trademark and copyright use.
Unauthorized reproduction, distribution, or commercial use is prohibited.
16. Website Availability
The Company makes reasonable efforts to ensure Website availability but may temporarily suspend access for maintenance, updates, or technical reasons. This does not affect confirmed and paid orders.
17. Privacy and Data Protection
All personal data is processed in accordance with the Company’s Privacy Policy and the Data Privacy Act of 2012 (RA 10173).

All complaints are handled promptly and in good faith. Unresolved concerns may be elevated to the Department of Trade and Industry (DTI) without prejudice to other legal remedies.
19. Amendments
These Terms may be updated to reflect legal, regulatory, or operational changes. Updates will be posted on the Website. Continued use constitutes acceptance of the revised Terms.
20. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Republic of the Philippines. Any disputes shall fall under the jurisdiction of Philippine courts or appropriate regulatory agencies.
